Subletting Agreement Switzerland β Legally Valid under Art. 262 CO
Anyone wishing to sublet their apartment or a room in Switzerland must obtain the main landlord's consent β and have a written subletting agreement. The Swiss Code of Obligations (Art. 262 CO) regulates the rights and obligations between main tenant and subtenant. A correct subletting agreement protects both parties: it sets rent, duration, rights of use and termination conditions. Do I need the landlord's permission for subletting?
Yes. Subletting is not permitted without the landlord's written consent (CO Art. 262). The landlord may only refuse consent for important reasons.
May I as main tenant charge more than I pay myself?
No. The subletting rent must not significantly exceed the main rent (CO Art. 262 para. 2b). Otherwise the landlord can refuse consent.
Is the subletting agreement valid in all cantons?
Yes. The agreement is based on federal law (CO Art. 262) and is valid in all Swiss cantons.
