Reclaiming Your Rental Deposit — Your Rights Under Swiss Law

The rental deposit (Mietkaution) can be up to three months' rent and must be returned by the landlord after the tenancy ends — unless justified claims exist. Many tenants in Switzerland wait months for their money, even though the law sets clear deadlines. Under Art. 267a OR, the deposit must be released within a reasonable period after handover of the apartment. If the landlord does not respond, a formal demand letter with a payment deadline is recommended. Our online form creates this letter in 2 minutes — with all legally relevant details, tailored to your situation. Valid in all Swiss cantons, instantly downloadable as PDF and Word.

When must the landlord return the deposit?

Under Swiss law, the landlord must release the deposit within 30 days of handover of the apartment (CO Art. 267a), unless there are justified claims such as damages or outstanding utilities.

What to do if the landlord does not respond?

Send a written demand letter with a payment deadline (10–14 days). If this receives no response, you can file a claim with the conciliation authority.

Can the landlord withhold the deposit for rental damages?

Yes, but only for actual, proven damages — not for normal wear and tear. Without a handover protocol, the burden of proof is difficult.
